Terms of sale

1. Seller

The works shown on unegalerie.com are sold by OSVITA, a société par actions simplifiée with a share capital of €200, registered office at 58 rue de Monceau, 75008 Paris, France, registered with the Paris Trade and Companies Register under number 993 137 611 (the "seller").

2. Scope and acceptance

These terms govern every sale concluded online on unegalerie.com. The buyer accepts them by placing an order; they are provided before payment and remain available on this page at all times.

3. The works

Each work is a unique piece by Jacky Buravant, described on its page: title, technique, dimensions, inventory number and photographs. Any unknown feature is marked "to be confirmed"; the buyer may ask any question before purchasing.

A certificate of authenticity issued by the seller comes with the work. Colours in the photographs may vary from screen to screen.

4. Prices

Prices are in euros, including VAT. Delivery charges for the chosen zone are shown before the order is confirmed, and are waived from €450 in every zone served. Collection in person is free.

The applicable price is the one shown when the order is placed.

5. Order and reservation

The buyer chooses a delivery option and is then taken to Stripe's secure payment page. During payment the work is reserved for the buyer: 30 minutes for a card payment, 72 hours for a bank transfer.

The sale is concluded when payment is actually received. If payment is not received within these periods, the reservation ends and the work is offered for sale again. Should two payments nonetheless be made for the same work, the second is refunded in full.

An order confirmation is sent by e-mail; a personal link lets the buyer follow its progress.

6. Payment

Payment is made by bank card or SEPA bank transfer, through Stripe. The seller never has access to card details.

The work remains the seller's property until the price has been paid in full.

7. Delivery and collection

Available options: collection in Martigues, France, the European Union and the rest of the world, at the rates in force; a zone without a rate is not offered. The work is shipped or made available no later than 30 days after the sale is concluded (French Consumer Code, art. L216-1). The tracking number is sent by e-mail.

The risk of loss or damage passes to the buyer when the buyer takes physical possession of the work (art. L216-4). Outside the European Union, import duties and taxes are payable by the buyer.

Collection in Martigues: the address and appointment arrangements are sent to the buyer once the purchase is complete.

8. Right of withdrawal

A consumer buyer has 14 days from receipt of the work, or from its handover on collection, to withdraw without giving any reason (art. L221-18). The buyer notifies the decision by an unambiguous statement sent to contact@unegalerie.com, or by using the form below (art. L221-21).

The work is returned in its original packaging no later than 14 days after this notification (art. L221-23). Return costs are borne by the buyer.

The seller refunds all sums paid, including standard delivery charges, no later than 14 days after being informed of the withdrawal; the refund may be withheld until the work has been received back (art. L221-24). The refund uses the original means of payment.

The buyer may be held liable for any loss in value of the work resulting from handling beyond what is necessary to establish its nature and characteristics (art. L221-23).

9. Legal guarantees

A consumer buyer benefits from the legal guarantee of conformity (French Consumer Code, art. L217-3 et seq.) for two years from delivery of the work, and from the guarantee against hidden defects (French Civil Code, art. 1641 to 1649).

10. Personal data

Data collected with the order (identity, contact details, address) is used only to fulfil it, for invoicing and for the seller's legal obligations. Payment is processed by Stripe. The buyer may exercise the rights of access, rectification and erasure at contact@unegalerie.com.

11. Mediation and disputes

In the event of a dispute, the buyer first sends a written complaint to contact@unegalerie.com. Failing a solution, the buyer may refer the matter free of charge to the seller's consumer mediator (art. L612-1): CM2C, Centre de la médiation de la consommation de conciliateurs de justice, 49 rue de Ponthieu, 75008 Paris, France, www.cm2c.net, online referral at www.cm2c.net/declarer-un-litige.php.

These terms are governed by French law, without depriving a consumer resident in another EU Member State of the protection afforded by the mandatory provisions of that country's law.
